Thinking Outside the Box
I originally wrote about this on April 8th in a post titled: "An OSHA Recommendation Run Amok".
Initially state safety regulators fined the school district. Then OSHA stepped in and said that the newspaper should be fined $31,500. And the discussion about what is right continues to swirl on the web.

Hey Steve! I think the question comes down to whether or not his employer was aware of how unsafe it was for him to get to the pree box. In all likelyhood he had probably mentioned it to them which would make the newspaper an 'exposing employer'. The school was certainly a 'creating employer'.

Thanks for your comment Jay. I agree. Although I've not seen any information about what the Buffalo newspaper knew or didn't know about this press box, the situation had existed for so long, and such a large number of reporters had used the press box, the difficulty of accessing the press box had to have been known. I'd also guess that for the same reason (its use over a long time by many people, with no problems) complacency existed... no one considered this to be a hazard.
